Adb Charter Agreement

14.3 As soon as practicing after the date of signature of this Agreement, the Government will make appropriate amendments to Australian law to bring into force the provisions of this Agreement until an international agreement between Australia and the ADB on the establishment of a resident mission is concluded. 12.7 The privileges, immunities, immunities and facilities granted in this Agreement are granted in the interest of the ADB and not for the benefit of individuals themselves. The ADB will waive the immunity granted to a person if it considers that such immunity would impede the judicial process and that the waiver is not necessary for the effective exercise of the functions of the ADB and/or persons to whom such privileges, immunities, exemptions and facilities have not been granted. (b) `ADB archives` means all ADB archives, including the Office archives, and includes all recordings, correspondence, documents, manuscripts, images, films, sound recordings and other documents belonging to the ADB, held or on behalf of them; (a) immunity from appeals and from any form of judicial proceedings in respect of acts they perform in an official capacity and/or activities related to their participation in the work of the ADB; ACCORDINGLY, the representatives duly authorized for this purpose have signed this Agreement. 3.3 The archives of the ADB, including the archives of the Office, are untouchable, wherever they are located. (c) “Charter”, which was adopted on 22Nd Agreement Establishing the Asian Development Bank, which entered into force on 9 August 1966, Chapter VIII of which has been faithfully applied in Australia in accordance with Article 57 of the Charter; 10.1 In Australia, the ADB shall enjoy treatment no less favourable to its official communications than that accorded by the Government of any other international organisation or diplomatic representation in Australia with regard to priorities, tariffs and surcharges for post, cable, telegrams, telegraphs, radiograms, faxes, telephone and other means of communication, as well as press councils for press and radio information. (a) are exempt from any tax, including indirect taxes, or allow a refund; (d) `family` means the following family members of officials of the Office who form part of the budget of such officials: (i) the spouse; (ii) a single child under 21 years of age; (iii) a single child under the age of 25 with full-time studies at an Australian educational institution; and (iv) a single child who, due to a physical or mental disability, is unable to support himself or herself. . . .
